Depremler nedeniyle bir\u00e7ok bina y\u0131k\u0131ld\u0131 ya da hasar ald\u0131. 45 binin \u00fczerinde insan da hayat\u0131n\u0131 kaybetti. Binalar\u0131n enkaz\u0131ndan geriye ac\u0131 dolu hayat hik\u00e2yeleri ve hat\u0131ralar kal\u0131rken, b\u00f6lgede t\u00fcm T\u00fcrkiye\u2019nin g\u00fcndeminde yer alan <strong>ev sahibi \u2013 kirac\u0131 anla\u015fmazl\u0131klar\u0131<\/strong> ortaya \u00e7\u0131kmaya ba\u015flad\u0131. Kimi \u00e7ad\u0131rda kimi ise ba\u015fka ile g\u00f6\u00e7mek zorundayken ev sahibinin kiray\u0131 istemesi \u015foku ile kar\u015f\u0131 kar\u015f\u0131ya kald\u0131.<\/p>\n<h3><strong>Kira S\u00f6zle\u015fmesi Kendili\u011finden Sona Erebilir<\/strong><\/h3>\n<p>Deprem sonras\u0131 kira s\u00f6zle\u015fmelerinin feshedilip feshedilemeyece\u011fi hususunu, s\u00f6zle\u015fmeye konu kiralanan\u0131n hasar durumuna g\u00f6re de\u011ferlendirilmesi gerekti\u011fine vurgu yapan Av. \u0130rem Akta\u015f, <em>\u201cBor\u00e7lar Kanunu&#8217;nun 301. maddesine g\u00f6re; ev sahibi, kiralanan\u0131 kararla\u015ft\u0131r\u0131lan tarihte, s\u00f6zle\u015fmede ama\u00e7lanan kullan\u0131ma elveri\u015fli bir durumda teslim etmek ve s\u00f6zle\u015fme s\u00fcresince bu durumda bulundurmakla y\u00fck\u00fcml\u00fcd\u00fcr. Kirac\u0131 ise, kiralanan\u0131 \u00f6zenli bir \u015fekilde kullanmak ve kira \u00f6deme borcunu yerine getirmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/em><\/p>\n<p><em>Deprem sonras\u0131 binan\u0131n y\u0131k\u0131lmas\u0131 durumunda, kira s\u00f6zle\u015fmesi kendili\u011finden sona erer. Binan\u0131n y\u0131k\u0131lmas\u0131yla birlikte, ev sahibinin kiralanan\u0131 kullan\u0131m amac\u0131na uygun bir \u015fekilde haz\u0131r bulundurmas\u0131 imk\u00e2ns\u0131zla\u015f\u0131r. Buradan hareketle, kirac\u0131n\u0131n kira \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc de ortadan kalkar. Akta\u015f, s\u00f6zlerine \u015f\u00f6yle devam etti:<em> \u201cOrta hasarl\u0131 binalarda kirac\u0131, hasar\u0131n ev sahibi taraf\u0131ndan onar\u0131lmas\u0131n\u0131, g\u00fc\u00e7lendirme \u00e7al\u0131\u015fmalar\u0131 yap\u0131lmas\u0131n\u0131 ve onar\u0131m s\u00fcresi boyunca kirada indirim yap\u0131lmas\u0131n\u0131 talep edebilir. Kiralanan\u0131n makul s\u00fcrede g\u00fc\u00e7lendirilmesi m\u00fcmk\u00fcn de\u011fil ise kanunda belirtilen \u015fartlara uyarak kira s\u00f6zle\u015fmesini feshedilebilir. Az hasarl\u0131 ya da hasars\u0131z binalarda ise, kira s\u00f6zle\u015fmesi devam etmekte olup, s\u00f6zle\u015fme bitimine kadar kirac\u0131n\u0131n kira bedelini \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc vard\u0131r. Ev hasars\u0131z olmas\u0131na ra\u011fmen depremden korktu\u011fu i\u00e7in evde oturmaya devam etmek istememe gibi psikolojik etkenlere ili\u015fkin kanunda a\u00e7\u0131k bir d\u00fczenleme bulunmamaktad\u0131r. Buna ra\u011fmen, 11 ili etkileyen deprem felaketinde art\u00e7\u0131 sars\u0131nt\u0131lar\u0131n hem \u015fiddetinin y\u00fcksek olmas\u0131 hem de s\u0131k aral\u0131klarla devam etmesi dolay\u0131s\u0131yla kirac\u0131n\u0131n s\u00f6zle\u015fmeyi devam ettirmesinin beklenemeyece\u011fi ayr\u0131ca \u00e7ekilmezlik unsurunun bulunmas\u0131 hususlar\u0131 bir arada de\u011ferlendirildi\u011finde kirac\u0131lar s\u00f6zle\u015fmeyi \u00f6nemli sebeple ola\u011fan\u00fcst\u00fc feshetme yoluna ba\u015fvurabilirler.\u201d<\/em><\/p>\n<h3><strong>Kirac\u0131 Depozitoyu Geri Alabilir<\/strong><\/h3>\n<p>Depozito yani g\u00fcvence bedeline de de\u011finen Av. Akta\u015f, <em>\u201c Depozito; kirac\u0131n\u0131n kira s\u00f6zle\u015fmesi devam etti\u011fi s\u00fcrece eve zarar verme ihtimaline kar\u015f\u0131 al\u0131nan bir bedeldir. Kirac\u0131dan kaynaklanmaks\u0131z\u0131n depremde y\u0131k\u0131lan yahut a\u011f\u0131r hasar alan binalarda, evde meydana gelen zararlar\u0131n kirac\u0131dan ba\u011f\u0131ms\u0131z ortaya \u00e7\u0131km\u0131\u015f olmas\u0131 nedeniyle, kira s\u00f6zle\u015fmesini fesheden <strong>kirac\u0131ya g\u00fcvence bedelinin<\/strong> ev sahibi taraf\u0131ndan <strong>iade edilmesi<\/strong> gerekmektedir. Ev sahibinin deprem sonucu binan\u0131n y\u0131k\u0131lmas\u0131nda bir kusuru bulunuyor ise, kirac\u0131 ev sahibinden tazminat talep edebilir. Ev sahibinin binan\u0131n y\u0131k\u0131lmas\u0131nda bir kusuru bulunmuyor ise, <strong>tazminat \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc<\/strong> ortadan kalkacakt\u0131r.<\/em><\/p>\n<p><em>Bununla birlikte kirac\u0131, ev sahibinin haks\u0131z fiilden kaynakl\u0131 kusursuz sorumlulu\u011funa da gidebilmektedir. Kiralanan\u0131n sa\u011flaml\u0131\u011f\u0131na ili\u015fkin sadece ev sahibi de\u011fil, kirac\u0131 da uzman bir bilirki\u015fiden rapor ald\u0131rabilir.
