At\u0131k mevzuat\u0131, sekt\u00f6r\u00fcm\u00fcz\u00fcn bel kemi\u011fi ve genellikle mevzuattaki t\u00fcm de\u011fi\u015fikliklere olumlu yakla\u015f\u0131l\u0131yor. \u00c7\u00fcnk\u00fc mevzuatlar, her zaman <strong>geri d\u00f6n\u00fc\u015f\u00fcm kalite standartlar\u0131n\u0131<\/strong> daha da art\u0131rmay\u0131 veya<strong> yerel, ulusal<\/strong> ya da <strong>uluslararas\u0131<\/strong> d\u00fczeyde geri d\u00f6n\u00fc\u015f\u00fcm oranlar\u0131n\u0131 art\u0131rmay\u0131 hedefliyor.<\/p>\n<p>Y\u00fcr\u00fcrl\u00fc\u011fe giren en yeni<strong> 3 mevzuat de\u011fi\u015fikli\u011fini<\/strong> de\u011ferlendirmek isteriz: <strong>Basel S\u00f6zle\u015fmesi<\/strong> <strong>Plastik At\u0131k De\u011fi\u015fiklikleri<\/strong>, \u00c7in&#8217;de <strong>kat\u0131 at\u0131k ithalat\u0131n\u0131n yasaklanmas\u0131<\/strong> ve k\u0131saca <strong>Avrupa Ye\u015fil Mutabakat\u0131.<\/strong><\/p>\n<h2><strong>Basel S\u00f6zle\u015fmesi Plastik At\u0131k De\u011fi\u015fiklikleri<\/strong><\/h2>\n<p>Giderek daha fazla \u00fclkenin <strong>plastikleri geri kazanmak<\/strong> ve <strong>geri d\u00f6n\u00fc\u015ft\u00fcrmek<\/strong> i\u00e7in gerekli<strong> tedbir<\/strong> ve <strong>mevzuatlar\u0131<\/strong> uygulamaya koymas\u0131na ra\u011fmen,<strong> kat\u0131 at\u0131k sahalar\u0131<\/strong> d\u00fcnya \u00e7ap\u0131nda milyonlarca ton <strong>plastik<\/strong> i\u00e7in ilk se\u00e7enek olmaya devam ediyor. <strong>2019\u2019da<\/strong> ger\u00e7ekle\u015fen<strong> Basel Konferans\u0131<\/strong>&#8216;nda devletler, <strong>plastik at\u0131\u011f\u0131n<\/strong> yasal olarak ba\u011flay\u0131c\u0131 bir \u00e7er\u00e7eveye dahil edilmesi i\u00e7in <strong>Basel S\u00f6zle\u015fmesi<\/strong>&#8216;ni de\u011fi\u015ftirmeyi kararla\u015ft\u0131rd\u0131lar. <strong>186<\/strong> \u00fclke, \u00e7evresel olarak sa\u011fl\u0131kl\u0131 bir geri d\u00f6n\u00fc\u015f\u00fcme girmeyecek olan plastik at\u0131klar\u0131n\u0131n ta\u015f\u0131nmas\u0131 ile ilgili yeni k\u0131s\u0131tlamalar getiren bu de\u011fi\u015fikli\u011fi kabul etti. Bu yeni k\u0131s\u0131tlamalar, <strong>ABD&#8217;de<\/strong> ge\u00e7erli de\u011fildir.<\/p>\n<p>De\u011fi\u015fiklikler, <strong>1 Ocak 2021<\/strong> tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girdi. Geri d\u00f6n\u00fc\u015ft\u00fcr\u00fclemeyen veya geri d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesi <strong>&#8220;zor&#8221;<\/strong> olan her t\u00fcrl\u00fc tehlikesiz plastik at\u0131k, art\u0131k <strong>&#8220;\u00f6zel dikkat&#8221;<\/strong> gerektiren<strong> at\u0131k kategorisine<\/strong> al\u0131narak ta\u015f\u0131nmas\u0131 <strong>Basel S\u00f6zle\u015fmesi&#8217;ndeki<\/strong> \u00f6nceden <strong>bildirim<\/strong> ve <strong>onay \u015fartlar\u0131na<\/strong> tabi tutuluyor.<\/p>\n<p>De\u011fi\u015fikliklerin amac\u0131, <strong>geri d\u00f6n\u00fc\u015f\u00fcme<\/strong> veya <strong>imhaya<\/strong> g\u00f6nderilen \u00e7o\u011fu<strong> plastik hurdan\u0131n<\/strong> ve <strong>at\u0131\u011f\u0131n<\/strong> uluslararas\u0131 sevkiyat\u0131n\u0131 kontrol ederek k\u00fcresel <strong>plastik at\u0131k ticareti<\/strong>ni daha \u015feffaf ve daha fazla denetime tabi bir hale getirmek. \u00a0Ayr\u0131ca Mevzuat\u0131n amac\u0131, <strong>geri d\u00f6n\u00fc\u015ft\u00fcr\u00fclebilir plastik sevkiyatlar\u0131<\/strong>na<strong> &#8220;gizlenen&#8221;<\/strong> geri d\u00f6n\u00fc\u015ft\u00fcr\u00fclemeyen plasti\u011fin bu malzemeyi <strong>y\u00f6netme imkan\u0131<\/strong> bulunmayan geli\u015fmekte olan \u00fclkelere g\u00f6nderilmesine son vermek. Ge\u00e7mi\u015fte geli\u015fmekte olan \u00fclkeler, kullanabilecek <strong>plastik malzemeleri kurtard\u0131ktan<\/strong> sonra, geri kalanlar\u0131 <strong>at\u0131k sahalar\u0131na<\/strong> g\u00f6nderiyor veya a\u00e7\u0131k havada ate\u015fle yak\u0131yordu.<\/p>\n<p>S\u00f6zle\u015fme kapsam\u0131nda tehlikeli at\u0131k olarak s\u0131n\u0131fland\u0131r\u0131lan plastiklerden baz\u0131lar\u0131 <strong>evsel at\u0131k y\u0131\u011f\u0131nlar\u0131nda<\/strong> bulundu\u011fundan bu <strong>yeni mevzuat<\/strong>, <strong>evsel at\u0131klar\u0131<\/strong> i\u015fleyen at\u0131k operat\u00f6rlerini do\u011frudan etkileyecek. Ayn\u0131 \u015fekilde, kar\u0131\u015f\u0131k evsel plastik at\u0131klar\u0131 ihra\u00e7 etmek amac\u0131yla, operat\u00f6rlerin art\u0131k detayl\u0131 bir \u00d6nceden Bilgilendirilmi\u015f <strong>Onay (PIC) prosed\u00fcr\u00fcne<\/strong> uymas\u0131 ve malzemeler i\u00e7in hem ihra\u00e7 eden hem de ithal eden \u00fclkelerin \u00f6nceden onay almas\u0131 gerekecek.<\/p>\n<p><strong>Basel S\u00f6zle\u015fmesi Plastik At\u0131k De\u011fi\u015fiklikleri<\/strong>, \u015f\u00fcphesiz halihaz\u0131rda plastik at\u0131k i\u00e7in ihracat pazarlar\u0131na ihtiya\u00e7 duyan at\u0131k i\u015fleme tesislerini etkileyecek. \u00d6nceden onay alma s\u00fcreci, ihracatta birka\u00e7 ay s\u00fcren gecikmelere neden olabilir ve at\u0131k i\u015fleme operat\u00f6rleri<strong> \u00d6nceden Bilgilendirilmi\u015f Onay (PIC) almak<\/strong> i\u00e7in beklerken tesislerinde \u00e7ok y\u00fcksek miktarda <strong>at\u0131k depolamak zorunda<\/strong> kalabilir. At\u0131k operat\u00f6rleri, bu \u015farta uymad\u0131klar\u0131 takdirde, malzemeleri masraflar\u0131 ihracat\u00e7\u0131ya ait olmak \u00fczere iade edilebilir. Ta\u015f\u0131ma s\u0131ras\u0131nda durdurulmas\u0131 halinde <strong>sevkiyatta gecikmeler<\/strong> olabilir ve baz\u0131 \u015fartlara uyulmamas\u0131 durumunda, malzemenin var\u0131\u015f \u00fclkesindeki otoriteler taraf\u0131ndan potansiyel olarak finansal cezalar dahil <strong>resmi tedbirler<\/strong> al\u0131nabilir.<\/p>\n<p>\u00c7o\u011fu karma plastik art\u0131k \u00f6nceden bilgilendirilmi\u015f onay gerektirse de baz\u0131 istisnalar bulunuyor.<strong> &#8220;Ye\u015fil Liste&#8221; at\u0131klar\u0131<\/strong> olarak adland\u0131r\u0131lan bu at\u0131klar i\u00e7in <strong>at\u0131k i\u015fleme operat\u00f6rlerinin<\/strong> bu malzemeyi \u00f6nceden bilgilendirmeden ihracata devam etmesine izin verilecek. <strong>Ye\u015fil Liste at\u0131klar\u0131, geri d\u00f6n\u00fc\u015f\u00fcm i\u015flemleri<\/strong>ne g\u00f6nderilen ve neredeyse sadece tek tip plastik i\u00e7eren <strong>plastikleri<\/strong> ve ayr\u0131 <strong>geri d\u00f6n\u00fc\u015ft\u00fcr\u00fclecek<\/strong> <strong>polipropilen (PP), polietilen (PE)<\/strong> ve <strong>polietilen tereflatat (PET)<\/strong> kar\u0131\u015f\u0131mlar\u0131n\u0131 i\u00e7eriyor. Di\u011fer t\u00fcm <strong>plastik at\u0131k ihracat\u0131<\/strong> ve ithalat\u0131n\u0131n, bildirilmesi ve ta\u015f\u0131ma \u00f6ncesi ihracat onay\u0131 al\u0131nmas\u0131 gerekiyor.<\/p>\n<p>Otomatik ay\u0131klama teknolojisindeki geli\u015fmeler, <strong>PET<\/strong> ve<strong> HDPE<\/strong> gibi renkli ve <strong>\u015feffaf plastik t\u00fcrleri<\/strong>nden <strong>polipropilen, polistiren<\/strong> ve <strong>PVC<\/strong> gibi di\u011fer polimerlere kadar plastik geri d\u00f6n\u00fc\u015f\u00fcm\u00fcnde ola\u011fan\u00fcst\u00fc safl\u0131k sonu\u00e7lar\u0131na ula\u015fma imkan\u0131 veriyor. Do\u011fru mevzuat, altyap\u0131 ve \u00f6zellikle de do\u011fru ay\u0131klama teknolojisi kombinasyonu uyguland\u0131\u011f\u0131 s\u00fcrece, tekli polimer y\u0131\u011f\u0131nlar\u0131nda daha \u00f6nce olanaks\u0131z olan <strong>% 99,99<\/strong>&#8216;un \u00fczerinde<strong> safl\u0131k d\u00fczeylerine<\/strong> ula\u015fmak m\u00fcmk\u00fcn.<\/p>\n<p>Bu malzeme, yaln\u0131zca \u00f6nceden izin al\u0131nmadan uluslararas\u0131 olarak g\u00f6nderilmekle kalmayacak, ayn\u0131 zamanda kar\u0131\u015f\u0131k plastiklerden \u00e7ok daha y\u00fcksek bir piyasa fiyat\u0131na sahip olacak. Bu nedenle <strong>kar\u0131\u015f\u0131k plastikleri tek ak\u0131\u015flara ay\u0131klamak<\/strong> ve <strong>ay\u0131rmak<\/strong> i\u00e7in hem<strong> ticari<\/strong> hem de <strong>yasal fakt\u00f6rler<\/strong> s\u00f6z konusu.<\/p>\n<h2><strong>\u00c7in&#8217;in kat\u0131 at\u0131k ithalat\u0131n\u0131 yasaklama karar\u0131<\/strong><\/h2>\n<p><strong>2021 y\u0131l\u0131<\/strong> ba\u015f\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe giren bir ba\u015fka <strong>at\u0131k mevzuat\u0131<\/strong> konusu ise \u00c7in&#8217;in <strong>plastik, ka\u011f\u0131t<\/strong> ve<strong> tekstil \u00fcr\u00fcnleri<\/strong> dahil kat\u0131 at\u0131k ithalat\u0131n\u0131 yasaklamas\u0131 oldu. \u00c7in, son <strong>40 y\u0131lda<\/strong> bu malzemeler a\u00e7\u0131s\u0131ndan \u00f6nemli bir pazard\u0131 ancak ithal geri d\u00f6n\u00fc\u015ft\u00fcr\u00fclebilen malzemeleri s\u0131n\u0131rland\u0131rma politikas\u0131 2013 y\u0131l\u0131nda hayata ge\u00e7mi\u015fti. Son kat\u0131 <strong>at\u0131k ithalat\u0131n\u0131 yasaklama<\/strong> karar\u0131, \u00c7in otoritelerinin yurt i\u00e7indeki malzemelerin geri d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesini daha fazla<strong> te\u015fvik etme<\/strong> ve \u00fclkenin ithalata daha az ihtiya\u00e7 duymas\u0131n\u0131 sa\u011flama konusundaki kararl\u0131\u011f\u0131n\u0131 yans\u0131t\u0131yor.<\/p>\n<p>\u00c7in&#8217;in <strong>kat\u0131 at\u0131k ithalat\u0131n\u0131 yasaklama<\/strong> karar\u0131, \u015fimdiye kadar malzemeleri i\u00e7in son pazar olarak \u00c7in&#8217;e ihtiya\u00e7 duyan at\u0131k i\u015fleme operat\u00f6rleri a\u00e7\u0131s\u0131ndan kapsaml\u0131 sonu\u00e7lar do\u011furacak. \u00c7in, bu konuda <strong>plastik at\u0131k<\/strong> ve baz\u0131 \u00fclkelerde karma <strong>ka\u011f\u0131t ithalat\u0131n\u0131 yasaklamak<\/strong> i\u00e7in ad\u0131mlar atan<strong> Malezya, Tayland<\/strong> ve <strong>Hindistan<\/strong> gibi \u00fclkelerin izinden gidiyor.<\/p>\n<p><strong>Basel S\u00f6zle\u015fmesi Plastik At\u0131k De\u011fi\u015fiklikleri&#8217;<\/strong>nde oldu\u011fu gibi, \u00c7in&#8217;in yeni kat\u0131 at\u0131k ithalat\u0131 yasa\u011f\u0131na uyulmamas\u0131 hem at\u0131k ta\u015f\u0131y\u0131c\u0131s\u0131 hem de ithalat\u00e7\u0131 a\u00e7\u0131s\u0131ndan <strong>500.000 RMB<\/strong> (yakla\u015f\u0131k 71.000 $) ve <strong>5 milyon RMB<\/strong> (yakla\u015f\u0131k 710.000 $) aras\u0131nda belirlenen <strong>a\u011f\u0131r cezalara<\/strong> yol a\u00e7abilir. <strong>G\u00fcmr\u00fck otoriteleri<\/strong>, ayr\u0131ca <strong>kat\u0131 at\u0131klar\u0131n imha<\/strong> i\u00e7in ihra\u00e7 yerine iade edilmesi talimat\u0131n\u0131 verecektir.<\/p>\n<p>Ge\u00e7mi\u015fte bu malzemeyi \u00c7in&#8217;e veya \u015fu anda bu malzemeleri yasaklayan di\u011fer \u00fclkelere ihra\u00e7 etmeye ihtiya\u00e7 duyan at\u0131k i\u015fleme operat\u00f6rleri, art\u0131k kat\u0131 at\u0131k malzemeleri i\u00e7in yeni son pazarlar bulmak veya \u00c7in&#8217;in <strong>ithalat ruhsat\u0131 verece\u011fi<\/strong> kat\u0131 at\u0131klar i\u00e7in talep etti\u011fi <strong>ola\u011fan\u00fcst\u00fc y\u00fcksek safl\u0131k<\/strong> oranlar\u0131na ula\u015fmak i\u00e7in <strong>ay\u0131klama teknolojisine yat\u0131r\u0131m yapmak<\/strong> durumunda kalacak.<\/p>\n<p><strong>At\u0131k ka\u011f\u0131t \u00fcr\u00fcnleri<\/strong> \u00f6rne\u011fine bakarsak, \u00c7in ge\u00e7mi\u015fte d\u00fcnyan\u0131n en b\u00fcy\u00fck ka\u011f\u0131t ithalat pazar\u0131yken \u015fu anda sadece <strong>% 99,5<\/strong> \u00fczerinde safl\u0131k d\u00fczeyine sahip olan at\u0131k ka\u011f\u0131t i\u00e7in ithalat ruhsat\u0131 veriyor. Bu da s\u00f6z konusu i\u015fletmecilerin, at\u0131k ka\u011f\u0131tlar\u0131n\u0131 \u00c7in&#8217;e ihra\u00e7 etmeye devam etmek istiyorlarsa ay\u0131klama, m\u00fcrekkep giderme ve geri d\u00f6n\u00fc\u015f\u00fcm \u00e7al\u0131\u015fmalar\u0131n\u0131 art\u0131rmas\u0131n\u0131 ve bunlara yat\u0131r\u0131m yapmas\u0131n\u0131 gerektiriyor.<\/p>\n<p>Bunun i\u00e7in de ka\u011f\u0131ttaki ka\u011f\u0131t d\u0131\u015f\u0131 maddeleri ay\u0131klamak ve ayr\u0131ca kahverengi karton, bask\u0131l\u0131 karton, plastik kaplamal\u0131 karton, boyanm\u0131\u015f ka\u011f\u0131t, gazete ka\u011f\u0131d\u0131 ve d\u00f6rt renkli bask\u0131l\u0131 (CMYK) ka\u011f\u0131t gibi farkl\u0131 ka\u011f\u0131t s\u0131n\u0131flar\u0131nda y\u00fcksek safl\u0131\u011fa sahip fraksiyonlar \u00fcretmek amac\u0131yla sens\u00f6r tabanl\u0131 ka\u011f\u0131t geri d\u00f6n\u00fc\u015f\u00fcm teknolojisindeki en yeni geli\u015fmelerden faydalanmak gerekiyor. Sens\u00f6r tabanl\u0131 ay\u0131klama, at\u0131k i\u015fleme operat\u00f6rlerinin malzemelerini \u00c7in&#8217;e ihra\u00e7 etmeye devam etmesini veya tercih ederlerse \u00fclke i\u00e7inde ya da yurt d\u0131\u015f\u0131nda malzemelerinin safl\u0131k d\u00fczeyleri sonucu \u00e7ok daha y\u00fcksek bir piyasaya fiyat\u0131 alabilece\u011fi alternatif pazar rotalar\u0131 bulmas\u0131n\u0131 sa\u011flayabilir.<\/p>\n<h2><strong>Avrupa Ye\u015fil Mutabakat\u0131<\/strong><\/h2>\n<p>\u00c7in&#8217;in t\u00fcm kat\u0131 at\u0131k ithalat\u0131n\u0131 yasaklama karar\u0131 ile e\u015f zamanl\u0131 olarak, Avrupa da ay\u0131klanmam\u0131\u015f <strong>plastik at\u0131klar\u0131n sevkiyat\u0131n\u0131 yasaklayan<\/strong> yeni AB sevkiyat kurallar\u0131n\u0131 hayata ge\u00e7irerek plastik kirlili\u011fi sorununu ele almak i\u00e7in ilave ad\u0131mlar at\u0131yor.<\/p>\n<p><strong>1 Ocak 2021&#8217;de<\/strong> y\u00fcr\u00fcrl\u00fc\u011fe giren <strong>Avrupa Komisyonu<\/strong>&#8216;nun <strong>Avrupa Ye\u015fil Mutabakat\u0131<\/strong> kapsam\u0131nda, plastik at\u0131klar\u0131n ihracat\u0131n\u0131, ithalat\u0131n\u0131 ve <strong>AB i\u00e7inde sevkiyat\u0131n\u0131<\/strong> d\u00fczenleyen yeni kurallar yer al\u0131yor.
