Milli parklar\u0131n aramaya a\u00e7\u0131lmas\u0131 gibi baz\u0131 maddelerin TBMM Genel Kurul\u2019unda de\u011fi\u015ftirilmesi, kar\u015f\u0131t g\u00f6r\u00fc\u015fleri bir miktar yumu\u015fat\u0131rken, TPAO lehine yap\u0131lan de\u011fi\u015fiklikler dikkat \u00e7ekti.<\/strong><\/p>\n<p>Y\u00fcr\u00fcrl\u00fc\u011fe giren yeni \u2018T\u00fcrk Petrol Kanunu\u2019, petrol ve do\u011falgaz sekt\u00f6r\u00fcn\u00fcn kurallar\u0131n\u0131 yeniden yazd\u0131. Haz\u0131rlanma a\u015famas\u0131nda petrol sekt\u00f6r\u00fcnde \u00e7al\u0131\u015fan m\u00fchendis ve i\u015f\u00e7i \u00f6rg\u00fctleri, yeni Petrol Kanunu Tasar\u0131s\u0131\u2019na \u2018milli menfaatler\u2019 ifadesinin kald\u0131r\u0131lmas\u0131, vergi d\u00fczenlemeleri ve \u00e7evre ile ilgili \u00f6nerilerinin yeterince dikkate al\u0131nmad\u0131\u011f\u0131 gerek\u00e7eleriyle kar\u015f\u0131 \u00e7\u0131km\u0131\u015ft\u0131.<\/p>\n<p>Ancak TBMM Genel Kurulu\u2019nda yap\u0131lan son dakika de\u011fi\u015fiklikleri ile \u00f6zellikle T\u00fcrkiye Petrolleri Anonim Ortakl\u0131\u011f\u0131\u2019na (TPAO) tan\u0131nan ayr\u0131cal\u0131klar\u0131n korunmas\u0131, \u00f6zel sekt\u00f6r i\u00e7in bir miktar hayal k\u0131r\u0131kl\u0131\u011f\u0131 yarat\u0131rken, kar\u015f\u0131 \u00e7\u0131kanlar\u0131 da bir \u00f6l\u00e7\u00fcde rahatlatt\u0131. Yeni ve eski kanun k\u0131yaslamas\u0131nda tart\u0131\u015f\u0131lan maddeler ve son dakika de\u011fi\u015fikliklerini derledik.<\/p>\n<h2>5 maddede yeni kanun<\/h2>\n<h2>1) Ama\u00e7 ve Kapsam<\/h2>\n<p>Eski Kanun: Kanunun amac\u0131; T\u00fcrkiye Cumhuriyeti petrol kaynaklar\u0131n\u0131n milli menfaatlere uygun, h\u0131zla, s\u00fcrekli ve etkili aranmas\u0131n\u0131, geli\u015ftirilmesini ve de\u011ferlendirilmesini sa\u011flamakt\u0131r.<\/p>\n<p>Yeni Kanun: Kanunun amac\u0131; T\u00fcrkiye Cumhuriyeti petrol kaynaklar\u0131n\u0131n milli menfaatlere uygun h\u0131zl\u0131, s\u00fcrekli ve etkili \u015fekilde aranmas\u0131n\u0131, geli\u015ftirilmesini ve \u00fcretilmesini sa\u011flamakt\u0131r.<\/p>\n<p>A\u00e7\u0131klama: 2007\u2019de 10. Cumhurba\u015fkan\u0131 Ahmet Necdet Sezer\u2019in d\u00f6rt veto gerek\u00e7esinden biri olan \u201cmilli menfaatlere uygun olarak\u201d ifadesi aynen korundu. Ancak eski kanunda \u201cmilli menfaatlerin korunmas\u0131\u201d ilkesinin yasan\u0131n t\u00fcm maddelerine yedirilmi\u015f bir kriter oldu\u011funu savunan sendika yetkilileri, yeni kanunda bu ilkenin sadece ama\u00e7 k\u0131sm\u0131nda b\u0131rak\u0131lmas\u0131na tepkili.<\/p>\n<h2>2) Vergilendirme<\/h2>\n<p>Eski Kanun: Petrol hakk\u0131 sahiplerini<a href=\"https:\/\/www.enerjigazetesi.ist\/wp-content\/uploads\/2012\/11\/petrol-fiyatlari-abd.jpg\"><img loading=\"lazy\" class=\"alignleft size-medium wp-image-3393\" title=\"eni-turk-petrol-kanununda-tpaoya-taninan-ayricaliklar-korundu\" src=\"https:\/\/www.enerjigazetesi.ist\/wp-content\/uploads\/2012\/11\/petrol-fiyatlari-abd-300x214.jpg\" alt=\"\" width=\"300\" height=\"214\" srcset=\"https:\/\/www.enerjigazetesi.ist\/wp-content\/uploads\/2012\/11\/petrol-fiyatlari-abd-300x214.jpg 300w, https:\/\/www.enerjigazetesi.ist\/wp-content\/uploads\/2012\/11\/petrol-fiyatlari-abd-69x50.jpg 69w, https:\/\/www.enerjigazetesi.ist\/wp-content\/uploads\/2012\/11\/petrol-fiyatlari-abd.jpg 400w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/a>n safi kazan\u00e7lar\u0131 \u00fczerinden \u00f6demekle m\u00fckellef olduklar\u0131 vergiler ve hissedarlar\u0131 ad\u0131na yapmalar\u0131 gereken gelir vergileri tevkifat\u0131 toplam\u0131 y\u00fczde 55\u2019i ge\u00e7emez.<\/p>\n<p>Yeni Kanun: Eski kanun korundu.<\/p>\n<p>A\u00e7\u0131klama: Kanun haz\u0131rlan\u0131rken bu oran\u0131n y\u00fczde 55\u2019ten, y\u00fczde 40\u2019a d\u00fc\u015f\u00fcr\u00fclmesi tepkiye neden olmu\u015ftu. S\u00f6z konusu madde Genel Kurul\u2019da y\u00fczde 55 olarak korundu. Sekt\u00f6r temsilcileri, \u00f6denen vergilerin zaten y\u00fczde 37.5 seviyelerinde oldu\u011funu savunarak, oran de\u011fi\u015fikli\u011finin devlet a\u00e7\u0131s\u0131ndan bir vergi geliri kayb\u0131na yol a\u00e7mayaca\u011f\u0131n\u0131 ancak \u00e7ok uzun y\u0131llar s\u00fcrecek arama projeleri \u00f6ncesinde yat\u0131r\u0131mc\u0131lara uzun vadede belli bir vergi \u00fcst limiti g\u00fcvencesi verilmesinin, daha \u00e7ok yat\u0131r\u0131m sa\u011flayaca\u011f\u0131n\u0131 savunmu\u015ftu.<\/p>\n<h2>3) TPAO\u2019ya \u0130li\u015fkin H\u00fck\u00fcmler<\/h2>\n<p>Eski Kanun: Petrol ile ilgili; m\u00fcsaade, arama ruhsatnamesi ve i\u015fletme ruhsatnamesi alma hakk\u0131 Devlet ad\u0131na TPAO\u2019ya aittir.<\/p>\n<p>Yeni Kanun: \u0130\u015fletme hakk\u0131 s\u00fcresi sona eren sahalar, i\u015fletme ruhsat\u0131 verilmek \u00fczere, Bakan onay\u0131yla m\u00fczayedeye \u00e7\u0131kar\u0131labilir. Ancak m\u00fczayedeye \u00e7\u0131k\u0131lmadan \u00f6nce Bakanl\u0131k bu sahay\u0131 i\u015fletme ruhsat\u0131 konusu olarak isteyip istemedi\u011fini s\u00fcre tayini suretiyle yazaca\u011f\u0131 bir yaz\u0131 ile TPAO\u2019dan sorar. TPAO\u2019nun talebi h\u00e2linde saha m\u00fczayedeye \u00e7\u0131kar\u0131lmaz. \u0130\u015fletme ruhsat\u0131 evvelce m\u00fczayedeye \u00e7\u0131kar\u0131lm\u0131\u015f bulunan bir i\u015fletme sahas\u0131n\u0131n tamam\u0131 veya bir k\u0131sm\u0131 yine Bakan onay\u0131yla m\u00fczayededen kald\u0131r\u0131labilir. \u0130dari yapt\u0131r\u0131m sonucu iptal edilen i\u015fletme ruhsat\u0131n\u0131n sahibi olan petrol hakk\u0131 sahibi veya sahipleri ayn\u0131 i\u015fletme ruhsat\u0131nda tekrar hak sahibi olamaz.<\/p>\n<p>A\u00e7\u0131klama: \u0130lk metinde, \u201cPetrol \u0130\u015fleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc bir i\u015fletme sahas\u0131 i\u00e7in m\u00fczayedeye \u00e7\u0131kmadan \u00f6nce bu sahay\u0131 isteyip istemedi\u011fini TPAO\u2019ya sorar\u201d \u015feklinde bir madde yer al\u0131yordu. \u00d6rne\u011fin yabanc\u0131 bir petrol \u015firketinin i\u015fletti\u011fi petrol sahas\u0131n\u0131n ruhsat s\u00fcresi doldu\u011funda, devlet \u00f6nce TPAO\u2019ya soracak, TPAO istemezse m\u00fczayedeye \u00e7\u0131k\u0131lacak. Yani TPAO\u2019nun ayr\u0131cal\u0131\u011f\u0131 korunmu\u015f oldu.<\/p>\n<h2>4 ) Arama Ruhsat\u0131 S\u00fcreleri<\/h2>\n<p>Eski Kanun: Karalarda: 4 + 2 (kanuna riayet ve h\u00fcsn\u00fcniyet \u015fart\u0131yla) + 2 (ke\u015fif ihtimali ve teminat \u015fart\u0131yla) + 3 (ke\u015fif \u015fart\u0131yla), Denizlerde: Ayn\u0131 s\u00fcreler y\u00fczde 50 oranda art\u0131r\u0131labilir.<\/p>\n<p>Yeni Kanun: Karalarda: 5 (i\u015f ve yat\u0131r\u0131m program\u0131 \u015fart\u0131yla) + 2 (program\u0131n yerine getirilmesi, en az bir sondaj i\u00e7eren ilave program\u0131n sunulmas\u0131 ve buna kar\u015f\u0131l\u0131k gelen y\u00fczde 2 teminat\u0131n yat\u0131r\u0131lmas\u0131 \u015fart\u0131yla) + 2 (ilk uzat\u0131mdaki \u015fartlarla) + 2 (ke\u015fif \u015fart\u0131); Denizlerde: Karadaki ayn\u0131 \u015fartlarla 8+3+3+2<br \/>\nA\u00e7\u0131klama: Eski kanuna g\u00f6re bir \u015firket yat\u0131r\u0131m yapmadan bir ruhsat\u0131 8 y\u0131l kapatma imk\u00e2n\u0131na sahipti. Yeni kanunda ise ruhsat verilirken ve her bir s\u00fcre uzat\u0131m\u0131nda, i\u015f ve yat\u0131r\u0131m program\u0131, kuyu kazma zorunlulu\u011fu ile teminat alt\u0131na al\u0131n\u0131yor.<\/p>\n<h2>5) Yat\u0131r\u0131mda \u00d6ncelikli Y\u00f6relere Sa\u011flanan Te\u015fvikler<\/h2>\n<p>Yeni Kanun: Petrol hakk\u0131 sahiplerince yap\u0131lacak yat\u0131r\u0131mlara verilecek te\u015fvikler Bakanlar Kurulu taraf\u0131ndan belirlenir.<\/p>\n<p>A\u00e7\u0131klama: Petrol hakk\u0131 sahiplerine yat\u0131r\u0131m yapt\u0131klar\u0131 illerdeki di\u011fer t\u00fcm yat\u0131r\u0131mlara verilen te\u015fviklerden yararlanabilme imk\u00e2n\u0131 sa\u011fland\u0131.<\/p>\n<h2>5.3 milyar dolarl\u0131k katma de\u011fer<\/h2>\n<p>PETFORM Ba\u015fkan\u0131 Orhan Duran\u2019\u0131n payla\u015ft\u0131\u011f\u0131 baz\u0131 bilgiler ise \u015f\u00f6yle:<\/p>\n<p>T\u00fcrkiye\u2019de g\u00fcnl\u00fck 630 bin varile yak\u0131n ham petrol ihtiyac\u0131n\u0131n sadece y\u00fczde 7\u2019sini, y\u0131lda 50 milyar metrek\u00fcpe yakla\u015fan do\u011falgaz ihtiyac\u0131m\u0131z\u0131n ise sadece y\u00fczde 2\u2019sini yerli kaynaklar\u0131m\u0131zdan kar\u015f\u0131layabiliyoruz.<\/p>\n<p>T\u00fcrk arama-\u00fcretim sekt\u00f6r\u00fc, bir yandan ithalat\u0131 2 milyar 650 milyon dolara tekab\u00fcl eden yerli \u00fcretim sayesinde d\u00fc\u015f\u00fcrerek, di\u011fer yandan milli has\u0131lay\u0131 2 milyar 650 milyon dolar artt\u0131rarak \u00fclke ekonomisine 5.3 milyar dolar katma de\u011fer sa\u011fl\u0131yor.<\/p>\n<h2>\u00d6zelle\u015ftirmenin somut izleri<\/h2>\n<p>PETROL-\u0130\u015f Sendikas\u0131 Genel Ba\u015fkan\u0131 Mustafa \u00d6zta\u015fk\u0131n, yeni kanun ile TPAO\u2019nun baz\u0131 ayr\u0131cal\u0131klar\u0131n\u0131n korundu\u011funu belirterek, \u201cAncak \u2018Devlet ad\u0131na arama ve i\u015fletme ruhsat\u0131 alma hakk\u0131 TPAO\u2019ya aittir\u2019 h\u00fckm\u00fc kald\u0131r\u0131larak, \u00f6zelle\u015ftirilmesinin \u00f6n\u00fc a\u00e7\u0131ld\u0131\u201d diye konu\u015ftu. Enerji y\u00f6netimi bir s\u00fcredir TPAO\u2019nun THY modeli ile \u00f6zelle\u015ftirilece\u011finin sinyallerini veriyordu. Bir sekt\u00f6r temsilcisi, \u201cTPAO\u2019nun halka arzda de\u011feri arts\u0131n\u201d mant\u0131\u011f\u0131n\u0131n da etkili oldu\u011funu vurgulad\u0131.<\/p>\n<h2>\u201cMilli park\u201d \u00e7\u0131kar\u0131ld\u0131<\/h2>\n<p>KANUNUN 10. maddesinin be\u015finci f\u0131kras\u0131nda \u201cOrman Kanunu\u2019na g\u00f6re orman say\u0131lan yerlerdeki ruhsat ve izin alanlar\u0131nda, ilgili mevzuata g\u00f6re izin almak ve bedelleri \u00f6denmek suretiyle petrol arama ve i\u015fletme faaliyetleri yap\u0131labilir\u201d deniliyor. Kanun tasar\u0131s\u0131nda milli parklar\u0131n da petrol aramas\u0131na a\u00e7\u0131lmas\u0131 \u00f6ng\u00f6r\u00fcl\u00fcyordu.
