Burcu K\u0131r\u00e7\u0131l<\/strong>, 01.07.2020 tarihine kadar kirac\u0131s\u0131n\u0131n <strong>tacir veya t\u00fczel ki\u015fi<\/strong> oldu\u011fu <strong>i\u015fyeri kira s\u00f6zle\u015fmeleri<\/strong>nin g\u00f6zden ge\u00e7irilmesinin faydal\u0131 olaca\u011f\u0131n\u0131 s\u00f6yledi.<\/p>\n<p>Yeni d\u00fczenlemeler <strong>hen\u00fcz y\u00fcr\u00fcrl\u00fck kazanmam\u0131\u015f<\/strong> oldu\u011fundan i\u015f yerlerine dair kira s\u00f6zle\u015fmesi ili\u015fkilerinde bu d\u00f6neme kadar genel olarak <strong>s\u00f6zle\u015fme serbestisi<\/strong> ve <strong>Yarg\u0131tay i\u00e7tihatlar\u0131<\/strong> \u00e7er\u00e7evesinde hareket edilmekte oldu\u011funu a\u00e7\u0131klayan Av. Burcu K\u0131r\u00e7\u0131l, <strong>1 Temmuz 2020<\/strong> tarihinden itibaren Yeni <strong>T\u00fcrk Bor\u00e7lar Kanunu<\/strong>\u2019nun \u00f6ng\u00f6rd\u00fc\u011f\u00fc d\u00fczenlemelerin ge\u00e7erli olaca\u011f\u0131n\u0131 belirtti. Av. Burcu K\u0131r\u00e7\u0131l, i\u015fyeri kira s\u00f6zle\u015fmelerinin <strong>ertelenen maddelerinin y\u00fcr\u00fcrl\u00fc\u011fe girmesi<\/strong>nin etkilerini <span style=\"text-decoration: underline;\">\u015f\u00f6yle a\u00e7\u0131klad\u0131:<\/span><\/p>\n<h2><strong>Etkisi nas\u0131l olacak? <\/strong><\/h2>\n<p>&#8211;\u00a0<strong>Kira ili\u015fkisinin devri<\/strong><strong>:<\/strong> 1 Temmuz 2020 itibar\u0131yla y\u00fcr\u00fcrl\u00fck kazanan <strong>323&#8217;\u00fcnc\u00fc madde<\/strong> ile i\u015fyeri kiralar\u0131nda kirac\u0131, kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131 olmadan kira ili\u015fkisini <strong>\u00fc\u00e7\u00fcnc\u00fc bir ki\u015fiye<\/strong> devredemeyecektir. \u00d6te yandan kiraya veren ise hakl\u0131 bir sebebi olmad\u0131k\u00e7a devir talebini reddedemeyecektir. Bununla birlikte, s\u00f6zle\u015fmesini devreden kirac\u0131, kira s\u00f6zle\u015fmesinin ihlalinden do\u011facak bor\u00e7lardan iki y\u0131l boyunca devralanla birlikte m\u00fcteselsilen sorumlu tutulmu\u015ftur.<\/p>\n<p><strong>&#8211; Kiralanan\u0131n s\u00f6zle\u015fmenin bitiminden \u00f6nce geri verilmesi:<\/strong> Y\u00fcr\u00fcrl\u00fc\u011fe girecek <strong>325&#8217;\u00fcnc\u00fc madde<\/strong> ile kirac\u0131n\u0131n hen\u00fcz <strong>s\u00f6zle\u015fme s\u00fcresi bitmeden<\/strong> ya da kanunda belirlenen <strong>fesih s\u00fcrelerine<\/strong> uymadan kiralanan\u0131 geri vermesi halinde, kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131n\u0131n, kiralanan\u0131n benzer ko\u015fullarla kiraya verilebilece\u011fi makul bir s\u00fcre i\u00e7in devam edece\u011fi d\u00fczenlenmi\u015ftir.<\/p>\n<p><strong>&#8211; Ola\u011fan\u00fcst\u00fc fesih hakk\u0131:<\/strong> Y\u00fcr\u00fcrl\u00fck kazanan 331. Madde h\u00fckm\u00fc; s\u00f6zle\u015fmenin icras\u0131n\u0131 kendisi i\u00e7in \u00e7ekilemez hale getiren nedenlerin varl\u0131\u011f\u0131 halinde taraflardan birinin di\u011ferine tazminat vermek ko\u015fulu ile kira s\u00f6zle\u015fmesinin bitmesinden evvel onu feshedilmesini m\u00fcmk\u00fcn hale gelmi\u015ftir. \u00d6nem arz eden husus, bu maddenin derhal fesih hakk\u0131 vermiyor olmas\u0131d\u0131r. Ola\u011fan\u00fcst\u00fc fesih halinde olu\u015facak zarar\u0131n tazmini h\u00e2kimin takdiri ile belirlenecektir.<\/p>\n<p><strong>&#8211; Ba\u011flant\u0131l\u0131 s\u00f6zle\u015fme yasa\u011f\u0131:<\/strong> Uygulamada kiraya verenin kira s\u00f6zle\u015fmesinin kurulmas\u0131 ya da s\u00fcrd\u00fcr\u00fclmesi i\u00e7in kirac\u0131ya kendisine hi\u00e7bir yarar sa\u011flamayacak olan bir borcu dayatt\u0131\u011f\u0131 g\u00f6r\u00fclebilmektedir. \u0130lgili madde bu gibi durumlarda s\u00f6zle\u015fmede zay\u0131f olan kirac\u0131y\u0131 korumakta ve kiraya veren taraf\u0131ndan dayat\u0131lan ve kirac\u0131y\u0131 ola\u011fan\u00fcst\u00fc bir y\u00fck\u00fcml\u00fcl\u00fck alt\u0131na koyan ba\u011flant\u0131l\u0131 s\u00f6zle\u015fmeyi h\u00fck\u00fcms\u00fcz saymakta fakat kira ili\u015fkisini ayakta tutmaktad\u0131r. Ba\u011flant\u0131l\u0131 s\u00f6zle\u015fme teklifinin kirac\u0131dan gelmesi halinde bu maddenin uygulanmas\u0131 m\u00fcmk\u00fcn olmayacakt\u0131r.<\/p>\n<p><strong>&#8211; Kirac\u0131n\u0131n g\u00fcvence vermesi:<\/strong> 1 Temmuz itibar\u0131yla y\u00fcr\u00fcrl\u00fc\u011fe girecek olan 342. madde ile kiraya veren en fazla \u00fc\u00e7 ayl\u0131k kira bedeli kadar g\u00fcvence bedeli (depozito) talep edebilecektir. Buna ek olarak yeni maddenin y\u00fcr\u00fcrl\u00fc\u011fe girmesi ile g\u00fcvence bedelinin do\u011frudan kiraya verene \u00f6denmesine ili\u015fkin uygulama ortadan kalkacakt\u0131r. Taraflar g\u00fcvence bedelinin para olarak \u00f6denmesini kararla\u015ft\u0131rm\u0131\u015f ise kirac\u0131, kiraya verenin r\u0131zas\u0131 olmadan \u00e7ekilmemek \u015fart\u0131 ile paray\u0131 vadeli bir tasarruf hesab\u0131na yat\u0131racakt\u0131r. G\u00fcvence bedelinin k\u0131ymetli evrak olarak \u00f6denmesi halinde ise s\u00f6z konusu k\u0131ymetli evrak kirac\u0131 taraf\u0131ndan ayn\u0131 \u015fartlar ile bankaya depo edilecektir.<\/p>\n<p><strong>&#8211; Kirac\u0131 aleyhine de\u011fi\u015fiklik yasa\u011f\u0131:<\/strong> Y\u00fcr\u00fcrl\u00fck kazanan yeni d\u00fczenleme ile kira s\u00f6zle\u015fmelerinde kira bedelinin belirlenmesi d\u0131\u015f\u0131nda kirac\u0131 aleyhine de\u011fi\u015fiklik yap\u0131lamayaca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r. S\u00f6z konusu madde ile s\u00f6zle\u015fmedeki zay\u0131f taraf oldu\u011fu kabul edilen kirac\u0131, kiraya verene kar\u015f\u0131 korunmak istenmi\u015ftir.<\/p>\n<p><strong>&#8211; Kira bedelinin belirlenmesi:<\/strong> Y\u00fcr\u00fcrl\u00fc\u011fe girecek olan 344. Madde; kira bedelinin belirlenmesine ili\u015fkin bir d\u00fczenleme getirmektedir. T\u00fcrk Bor\u00e7lar Kanunu \u00f6ncesinde kira bedelinin belirlenmesine dair bir d\u00fczenleme bulunmad\u0131\u011f\u0131ndan bu konu uygulamada \u00e7ok fazla ihtilaf yaratmaktayd\u0131. Yeni d\u00fczenlemeyle taraflar, yenilenen kira d\u00f6nemlerinde kira bedelinin ne olaca\u011f\u0131na ili\u015fkin bir anla\u015fma yapmam\u0131\u015f ise kira bedeli h\u00e2kim taraf\u0131ndan belirlenir. \u015eayet bir anla\u015fma yap\u0131lm\u0131\u015f ise bunun ge\u00e7erlili\u011fi bir \u00f6nceki y\u0131l\u0131n \u00dcFE\u2019deki art\u0131\u015f oran\u0131n\u0131 a\u015fmamas\u0131na ba\u011fl\u0131d\u0131r. Be\u015f y\u0131ldan uzun s\u00fcreli ya da be\u015f y\u0131lda bir yenilenen s\u00f6zle\u015fmelerde anla\u015fma olup olmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n 5 y\u0131ldan sonras\u0131 i\u00e7in uygulanacak yeni kira bedeli \u00dcFE\u2019deki art\u0131\u015f oran\u0131, kiralanan\u0131n durumu ve emsal kira bedelleri g\u00f6z \u00f6n\u00fcne al\u0131narak hakkaniyete uygun olarak h\u00e2kim taraf\u0131ndan belirlenecektir.<\/p>\n<p><strong>&#8211; Kirac\u0131 aleyhine d\u00fczenleme yasa\u011f\u0131:<\/strong> Y\u00fcr\u00fcrl\u00fc\u011fe girecek 346. madde ile kirac\u0131ya kira bedeli ve temizlik \u2013 aidat bak\u0131m gideri gibi yan giderler d\u0131\u015f\u0131nda ba\u015fka bir \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getirilemeyece\u011fi, \u00f6zellikle kira bedelinin zaman\u0131nda \u00f6denmemesi halinde ceza ko\u015fulu \u00f6denece\u011fine veya sonraki kira bedellerinin muaccel hale gelece\u011fine ili\u015fkin anla\u015fmalar\u0131n ge\u00e7ersiz olaca\u011f\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p><strong>&#8211; Dava sebeplerinin s\u0131n\u0131rl\u0131l\u0131\u011f\u0131:<\/strong> 1 Temmuz 2020 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girecek olan 354. Madde, dava yoluyla kira s\u00f6zle\u015fmesinin sona erdirilmesine ili\u015fkin h\u00fck\u00fcmlerin kirac\u0131 aleyhine de\u011fi\u015ftirilmeyece\u011fini d\u00fczenlemi\u015ftir. Bu madde ile kirac\u0131n\u0131n kanunda belirlenen nedenler d\u0131\u015f\u0131nda tahliye edilmesine imk\u00e2n tan\u0131nmam\u0131\u015f, tahliye nedenlerinin s\u00f6zle\u015fme ile \u00e7e\u015fitlendirilmesinin \u00f6n\u00fc kapanm\u0131\u015ft\u0131r. Bu d\u00fczenlemenin amac\u0131 da kirac\u0131n\u0131n korunmas\u0131 d\u00fc\u015f\u00fcncesinden kaynaklanmaktad\u0131r.<\/p>\n<p><span style=\"text-decoration: underline;\">Sonu\u00e7 olarak;<\/span> yaz\u0131m\u0131zda da k\u0131saca de\u011findi\u011fimiz <strong>T\u00fcrk Bor\u00e7lar Kanunu<\/strong>\u2019nun<strong> kirac\u0131s\u0131 tacir<\/strong> veya<strong> t\u00fczel ki\u015fi<\/strong> olan i\u015fyeri kiralar\u0131na ili\u015fkin h\u00fck\u00fcmleri yeni bir erteleme olmamas\u0131 halinde <strong>01.07.2020<\/strong> tarihinde y\u00fcr\u00fcrl\u00fck kazanacakt\u0131r. \u0130lgili maddelerin <strong>s\u00f6zle\u015fme serbestisine s\u0131n\u0131rlamalar getirmesi<\/strong> ve baz\u0131 noktalarda yerle\u015fik<strong> Yarg\u0131tay uygulamalar\u0131n\u0131n \u00f6n\u00fcne ge\u00e7mesi<\/strong> nedeniyle uygulamada <strong>ihtilafa yol a\u00e7aca\u011f\u0131<\/strong> muhtemeldir.
